MEMORANDUM OF CONSIDERATION OF APPLICATION BEFORE THE AFBCMR
SUBJECT:
Having carefully reviewed this application, we agree with the recommendations of the
Air Force offices of primary responsibility and adopt the rationale expressed as the basis for our
decision that the applicant has been the victim of either an error or an injustice. Therefore, we
recommend that:
The pertinent military records of the Department of the Air Force relating to
APPLICANT, be corrected to show that:
a. The Fitness Assessments (FAs) dated 23 February 2011, 16 May 2011 and
10 February 2012, be declared void and removed from the Air Force Fitness Management
System.
b. The AF Form 910, Enlisted Performance Report (EPR) (AB thru TSgt) rendered
for the period of 23 May 2010 through 22 May 2011, be declared void and removed from his
records.

Since his 21 April 2010 FA was removed from his record, which was the basis for his demotion action, his rank should be restored. There is no demotion action or demotion order in his personnel records. The applicant contends that his former grade should be restored because his demotion was based upon four consecutive fitness assessment (FA) failures, but one of the four failures was later declared void and removed from his records.

While the applicant provided AF Forms 422, Notification of Air Force Members Qualification Status, dated 2 May 2011, 11 October 2011, and 29 January 2012, which exempted her from the 1.5 mile run, pushups, and sit-up components of the contested FAs, she was evaluated on the height, weight, and abdominal circumference in accordance with her profile.
